An investigation by Ofgem into whether Power Balancing Services and GF Power Peaking provided inaccurate or misleading information about planning consent on capacity market units entered into the capacity market auction in December 2014, has found that neither generator breached the rules of the capacity market.
The regulator said it has closed the investigations after both generators were able to supply relevant information that proved they had obtained the necessary planning consents for the units.
GF Power Peaking secured capacity agreements for all nine of its new build generators and an existing generator in the capacity auction. Two new builds secured 15 year capacity agreements with the rest securing one year agreements for 58MW of generating capacity.
Power Balancing Services secured capacity agreements for four of its six generating units, securing 14 year contracts for 28MW of generating capacity.
Ofgem opened investigations in May 2015 into five generators which successfully participated in the capacity auction, including Power Balancing Services and GF Power Peaking.
The investigations into Berangere, Adret and Alkane Energy are ongoing, Ofgem said.
