1.1 These are the membership terms for Utility Week (the “Service”), a service provided by Faversham House Ltd. (“we”/”us”).
1.2 By subscribing to the Service, you confirm your agreement to these terms, which constitute all applicable terms of your membership, and that you are not relying on any previous representation by us that is not included in these terms.
1.3 If you have subscribed to an individual membership, you personally are the Member and User. If you have subscribed to a corporate membership on behalf of a company or other entity, it is the Member and has purchased a number of logins for individual Users at the Member. You warrant your authority to commit the corporate Member to these terms.
2.1 There are different membership options for our Services, which may include a printed and/or digital magazine, access to web pages or brochures and various other membership offers where applicable. All information and material made available though the Service, including (but not limited to) text, pictures, sounds, graphics, videos, emails, links and posts, is called “Content”.
2.2 Online access to Content is limited to registered Users at a Member with a current subscription. Each User may be logged in on up to 3 devices at any time. YOU MUST NOT SHARE A USER’S LOGIN DETAILS WITH ANYONE OTHER THAN THAT USER. SHARING USER LOGINS IS A SERIOUS BREACH OF THESE TERMS, WHICH CAN RESULT IN OUR TERMINATING YOUR MEMBERSHIP AND/OR THE USER ACCOUNTS CONCERNED UNDER 6.2 BELOW. A Member can change its Users and/or its contact details and/or purchase additional User logins by contacting us in writing.
2.3 If your membership includes a printed magazine, you will receive all issues published during your subscription period, starting with the next available issue at the date of your order or renewal.
2.4 Print and email magazines will be delivered to the postal and email addresses given when placing the order.
3.1 Subscriptions are paid in advance for an agreed period. They do not automatically renew and we will notify you before renewal is due.
3.2 The printed element of a subscription is zero-rated for VAT. VAT is charged on the digital elements of a subscription at the standard rate.
4. Intellectual Property Licence
4.1 The intellectual property rights in all Content are owned by us and/or our licensors.
4.2 You may copy, download, print or save small portions of Content for your personal use only. Any commercial use of Content requires our prior written consent.
4.3 We may suspend Users’ access to online Content whilst we investigate a suspected infringement of intellectual property rights.
5. Data Protection
6.1 Subscriptions may be cancelled by the Member at any time by written notice to us. We will make a pro rata refund less an administration fee of £10 + VAT. Where a print magazine is included in the subscription, the pro rata refund is calculated on the basis of issues unfulfilled.
6.2 We may terminate your Membership and/or any User account without a refund for the remaining subscription period if you are in serious breach of any of these terms. Failure to pay for a subscription, sharing User logins with colleagues or third parties or infringement of our intellectual property rights are examples of serious breaches.
7.1 We can update these terms at any time by notifying you in writing.
7.2 Major changes to these terms or price increases for subscriptions only take effect on on your next subscription renewal.
8. Applicable Law
8.1 These terms are subject to English law and the courts of England have jurisdiction over any dispute.
8.2 If these terms have been translated into another language, the English version prevails if there is any inconsistency.
